These Terms of Service («Terms») govern your use of the mobile application Dog monitor Doggy («Doggy», the «App»), published by Have a nice day e.U. (the «Company», «we», «us»). By accessing or using Doggy you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App.

1. Acceptance

By downloading, installing or using Doggy you confirm that you accept these Terms and that you are responsible for compliance with any applicable local laws.

2. License

Have a nice day e.U. grants you a limited, non-exclusive, non-transferable, revocable license to use Doggy on devices you own or control, for personal, non-commercial use. You may not: modify, copy or create derivative works of the App; use it for any unlawful purpose; decompile or reverse engineer any software contained in the App; or remove any copyright or proprietary notices. This license terminates automatically if you violate these Terms.

3. Use of the service

Doggy lets you use one device as a camera to stream live audio and video to another device used as a monitor. You are responsible for using the App lawfully and only to monitor spaces you own or are authorized to monitor. You must not use Doggy to observe or record other people without their knowledge and consent, or otherwise to violate the privacy or rights of others.

4. Subscriptions and payments

The App offers optional paid subscriptions (e.g. weekly, yearly) and one-time purchases. Purchases are processed through Google Play on Android and the Apple App Store on iOS. Subscriptions are auto-renewable: payment is charged to your store account at confirmation of purchase, and the subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Google Play or Apple ID account settings.

5. Disclaimer

Doggy is provided on an «as is» and «as available» basis. To the maximum extent permitted by law, Have a nice day e.U. makes no warranties, express or implied, including as to merchantability, fitness for a particular purpose, reliability, or uninterrupted availability. Doggy is an aid and must not be relied upon as the sole means of supervising a pet, a person or any property. Network conditions, device settings or third-party services may affect streaming and alerts.

6. Limitation of liability

To the maximum extent permitted by law, Have a nice day e.U. and its suppliers shall not be liable for any indirect, incidental or consequential damages (including loss of data or profit, or interruption) arising from the use of or inability to use Doggy. Some jurisdictions do not allow such limitations, so they may not apply to you.

7. Changes

We may revise these Terms at any time. Changes are effective upon posting on this page. By continuing to use Doggy you agree to the then-current Terms.

8. Governing law

These Terms are governed by the laws of Austria, the seat of Have a nice day e.U., without regard to conflict-of-law rules, subject to any mandatory consumer-protection rights in your country of residence.
